PRIVACY POLICY

Introduction: This Privacy Policy outlines how we collect, use, maintain and disclose User information collected on Colorverse and how we safeguard such information and data. “Company”, “we”, “us”, “our” in this Privacy Policy refers to Presto Color Sdn Bhd, the operator and owner of Colorverse, including its affiliates companies or Channel Partner, while “Colorverse” refers to our Services. In this context, the term “you” or “your” in this Privacy Policy extends to any individual whose personal data has been provided to us on Colorverse and/or has been collected in other circumstances as described in Section 3 of this Privacy Policy.

Colorverse is a Web3 SocialFi Community presented by Presto Color Sdn Bhd which adapts a two-way income stream by rewarding Creators and Fans who contribute. Users who share content are referred to as “Creators”, while users who follow and pay to view Creators’ content as “Fans”. This Privacy Policy explains our practices with respect to personal data and information we collect and process about you. This includes information we collect through, or in association with, our official website located at (colorverse.social) and creator portal website located at (portal.colorverse.social), our services that we may offer from time to time via our websites, our related social media sites (Facebook, Instagram, YouTube, Twitter, Discord, LinkedIn and Medium), or otherwise through your interactions with us (the websites, our social media pages, and services, collectively, the “Services”).

Interpretation: For the avoidance of doubt, capitalised terms used herein shall have the same meanings prescribed in the Terms of Use for All Users.

  1. Your consent is important :
    When you request for information or sign up for our services or when you enter into any Fan/Creator Transactions on Colorverse, you may be required to provide us with your personal data and information. In doing so, you consent to our use of your personal data and information in accordance with this Privacy Policy. Your personal data may have otherwise been provided to us by a third party for products or services that these third parties have sought from Colorverse.

    We may collect your sensitive personal data, if you utilize our services to upload or watch video or make any transaction, which require you to disclose such sensitive personal data to us. We will only use your sensitive personal data to provide the service(s) you signed up for. If we collect, use, maintain or disclose your sensitive personal data, we will ask for your explicit consent.

    You have the choice, at any time, not to provide your personal data/sensitive personal data or to revoke your consent to our processing of your personal data/sensitive personal data. However, failure to provide such personal data/sensitive personal data or revocation of your consent to process personal data/sensitive personal data provided may result in us being unable to provide you with effective and continuous services.

  2. Types of personal data we collect
    Personal data refers to any information that relates directly or indirectly to an individual, who is identified or identifiable from that information or from that and other information in the possession of Colorverse, including any sensitive personal data and expression of opinion about the individual.

    We may collect your sensitive personal data, if you utilize our services to upload or watch video or make any transaction, which require you to disclose such sensitive personal data to us. We will only use your sensitive personal data to provide the service(s) you signed up for. If we collect, use, maintain or disclose your sensitive personal data, we will ask for your explicit consent.

    You have the choice, at any time, not to provide your personal data/sensitive personal data or to revoke your consent to our processing of your personal data/sensitive personal data. However, failure to provide such personal data/sensitive personal data or revocation of your consent to process personal data/sensitive personal data provided may result in us being unable to provide you with effective and continuous services.

  3. Ways we collect your personal data
    We obtain your personal data in various ways, such as: as in

    • a. when you sign up for or use one of the Services we provide or when you sign up for a User Account on Colorverse;

    • b. when you contact us through various methods such as application forms, emails and letters, telephone calls and conversations you have with our staff in our office. If you contact us or we contact you using telephone, we may monitor or record the phone call for quality assurance, training and security purposes;

    • c. from our analysis of your transactions (e.g., payment history);

    • d. we may also obtain your personal data when you participate in customer or creator surveys or when you sign up for any of our competitions or promotions;

    • e. when we obtain any data and information from third parties (e.g. partner companies, google analysis);

    • f. from publicly available sources and/or our service providers.

  4. Personal data we collect from our platforms

    • a. IP Address
      An IP address is a number that is automatically assigned to your computer when you signed up with an Internet Service Provider. When you visit our websites, your IP address is automatically logged in our server. We use your IP address to help diagnose problems with our server, and to administer our websites. From your IP address, we may identify the general geographic area from which you are accessing our websites. Generally, we do not link your IP address to anything that can enable us to identify you unless it is required by law and regulation.

    • b. Information on Cookies
      A cookie is an element of data that a website can send to your browser, which may then store it on your system. We use cookies in some of our pages to store visitors' preferences and record session information. The information that we collect is then used to ensure a more personalised service level for our users. You can change settings on your browser so that you will be notified when you receive a cookie. Please refer to your browser documentation to check if cookies have been enabled on your computer or to request not to receive cookies.

    • c. from our analysis of your transactions (e.g., payment history);

    • d. we may also obtain your personal data when you participate in customer or creator surveys or when you sign up for any of our competitions or promotions;

    • e. when we obtain any data and information from third parties (e.g. partner companies, google analysis);

    • f. from publicly available sources and/or our service providers.

  5. Information Collected from Third-Party Companies
    We may receive personal and/or anonymous data about you from companies that offer their products and/or services for use in conjunction with our Service or whose products and/or services may be linked from our Service. For example, third-party crypto wallet providers provide us with your blockchain address and certain other information you choose to share with those third-party crypto wallets. We may add this to the data we have already collected from or about you through our Service.

  6. Purpose of processing your personal data
    We may process your personal data for the following reasons:

    • a. general administration;

    • b. manage and maintain your account(s) with us;

    • c. respond to your enquiries and complaints and to generally resolve disputes;

    • d. update, consolidate and improve the accuracy of our records;

    • e. produce data, reports and statistics which have been aggregated in a manner that does not identify you as an individual;

    • f. developing, improving, operating, providing, predicting, or performing, enhancing the Services and your experience with them, providing customer service, processing or fulfilling transactions, verifying identity, and processing payments;

    • g. detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;

    • h. debugging to identify and repair errors that impair existing intended functionality;

    • i. conduct research and survey, which solely for analytical purposes including but not limited to data mining and analysis of your transactions with us;

    • j. marketing communications;

    • k. enforcing our Terms of Use and other usage policies;

    • l. meet the disclosure requirements of any law binding on us;

    • m. for audit, compliance and risk management purposes; or

    • n. any other purpose that we deem necessary and/or as required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities.

    • From time to time, we may share your personal data with our affiliates and/or subsidiaries, our agents or strategic partners and other third parties (“other entities”) as we deem fit and you may receive marketing communication from us or from these other entities about products and services that may be of interest to you. If you no longer wish to receive these marketing communications, please notify us to withdraw your consent and we will stop processing and sharing your personal data with these other entities for the purpose of sending you marketing communications.

      Please be notified that once we receive confirmation that you wish to withdraw your consent for marketing or promotional materials/communication, it may take up to fourteen (14) working days for your withdrawal to be reflected in our systems. Therefore, you may still receive marketing or promotional materials/communication during this period of time. Please note that even if you opt out from receiving marketing or promotional materials, we may still contact you for other purposes in relation to the accounts, facilities or services that you hold or have subscribed to with Colorverse.

  7. Security of your personal data The security of your personal data is our priority. We take all physical, technical and organizational measures needed to ensure the security and confidentiality of personal data.

    The disclosure of your data may involve the transfer of your personal data to places outside of Malaysia, and by providing us your personal data you agree to such a transfer where it is required to provide you the services you have requested, and for the performance of any contractual obligations you have with Colorverse including for storage purposes.

  8. Period to which we may retain your personal data We will only retain your personal data for as long as necessary to fulfil the purpose(s) for which it was collected or to comply with legal, regulatory and internal requirements. Afterwards we will destruct or permanently delete your data.

    Please note that we may update this Privacy Policy from time to time. If there are material changes to this Privacy Policy, we will notify you by posting a notice of such changes on our websites or by sending you a notification directly. Do periodically review this Privacy Policy to stay informed on how we are protecting your information.

  9. Ways to access / correct / update your personal data
    We are committed to ensure that the personal data we hold about you is accurate, complete, not misleading and up-to-date. If there are any changes to your personal data or if you believe that the personal data, we have about you is inaccurate, incomplete, misleading or not up-to-date, please contact us by email at support@colorverse.social so that we may take steps to update your personal data.

    You have the right to access your personal data. If you would like to request access to your personal data, please contact us. Please note that depending on the information requested we may charge a small fee. We may also take steps to verify your identity before fulfilling your request for access to your personal data.

  10. Third party link & advertising
    Colorverse may provide hyperlinks to third party sites ("Linked Sites") for convenience only, and the inclusion of the hyperlink does not imply any endorsement of the Linked Site by Colorverse or its affiliates. In addition, the inclusion of third-party advertising on the Sales Channel (whether with or without hyperlinks) is not an endorsement or recommendation of the third-party advertiser by Colorverse or its affiliates.

    You acknowledge and agree that Linked Sites are not under the control of Colorverse and that Colorverse is not liable or responsible for:

    1. a. any act, omission or negligence of any person who administers or owns any Linked Sites;

    2. b. the copyright compliance, legality or decency of any Linked Sites;

    3. c. the accuracy or reliability of any information provided by any Linked Sites;

    4. d. the privacy policies of the Linked Sites;

    5. e. any goods or services provided by any person who administers or owns any Linked Sites; or

    6. f. the performance of any obligation owing to by any person who administers or owns any Linked Sites.

  11. Third party crypto wallets To use our Service, you must use a third-party crypto wallet which allows you to engage in transactions on public blockchains. Your interactions with any third-party crypto wallet are governed by the applicable terms of service and privacy policy of that third party.

  12. Other important information about personal data and the services

    1. a. Identity Verification
      We require checks for Creators to ensure that we do not knowingly offer our Services to or collect personal data from anyone under 18 or anyone using a false identity and offer checks as an option for Fans.

    2. b. Payment Information
      Payments made by Fans to access content are processed by our payment providers or third-party crypto wallet. For example, when a Fan make a payment that is processed by our payment provider, the Fan will provide that payment provider with his/her credit card number, credit card expiration date, and security code, which payment provider process and store subject to their privacy policy and terms of service. We do not receive any full credit card number, credit card expiration date, or the security code of the Fans. Instead, payment provider provides us with a “token” that represents the Fan’s account, the card’s expiration date, card type and the first two and last four digits of the Fan’s card number. If a Fan is required to provide his/her name and email address to payment provider, then they also provide us with that information. Payments issued to Creators for their Content are made by Colorverse through Direct Bank Transfer by using the bank account information that we have collected from Creators. We will store the bank account details provided by Creators subject to our Privacy Policy and Terms of Use.

    3. c. Collection of Personal Data from Children
      Our Services are generally not intended for anyone under 18. Anyone under 18 years of age must have their parent or guardian’s consent to the Terms of Use for All Users.

    4. d. Third-Party Websites and Services
      As a convenience, we may refer or provide links to third-party websites and services, including those of unaffiliated third parties, our affiliates, service providers, and third parties with which we do business (including, but not limited to, our service providers). When you access these third-party services, you leave our Services, and we are not responsible for, and do not control, the content, security, or privacy practices employed by any third-party websites and services. You access these third-party services at your own risk. This Privacy Policy does not apply to any third-party services; please refer to the Privacy Policy or policies for such third-party services for information about how they collect, use, and process personal data.

    5. e. Business Transfer
      We may, in the future, sell or otherwise transfer some or all of our business, operations or assets to a third party, whether by merger, acquisition or otherwise. Personal data we obtain from or about you via the Services may be disclosed to any potential or actual third- party acquirers and may be among those assets transferred.

    6. f. Do Not Track
      We currently do not use any cross-site tracking technologies and do not currently process or comply with any web browser’s “do not track” signal or similar mechanisms. Note, however, that you may find information about how to block or reject certain tracking technologies in our Cookie Notice.

    7. g. Availability of Fan’s information to Creator
      In consideration of the nature of services provided by Colorverse, the Fan consents to his/her limited personal data such as mobile number, email address, joining date and transaction amount (collectively, the “Fan’s Information”), being available on Colorverse’s platform to the Creator only. The Fan shall have the right to withdraw his/her consent to disclosure of the Fan’s Information to the Creator by way of written notification to Colorverse at support@colorverse.social or any such similar option as may be made available on Colorverse’s platform.

  13. Modifications and Updates to this Privacy Policy
    This Privacy Policy replaces all previous disclosures we may have provided to you about our information practices with respect to the Services. We reserve the right, at any time, to modify, alter, and/or update this Privacy Policy, and any such modifications, alterations, or updates will be effective upon our posting of the revised Privacy Policy. We will use reasonable efforts to notify you in the event material changes are made to our processing activities and/or this Privacy Policy, such as by posting a notice on the Services or sending you an email. Your continued use of the Services following our posting of any revised Privacy Policy will constitute your acknowledgement of the amended Privacy Policy. We encourage you to review this Privacy Policy periodically to stay informed.

  14. Applicability of this Privacy Policy
    This Privacy Policy should be read in conjunction with the Terms of Use for All Users, Terms of Use for Fans , Terms of Use for Creators and Acceptable Use Policy that govern your use of the Services. This Privacy Policy applies regardless of the means used to access or provide information through the Services.

    This Privacy Policy does not apply to information from or about you collected by any third-party services, applications, or advertisements associated with, or websites linked from, the Services. The collection or receipt of your information by such third parties is subject to their own privacy policies, statements, and practices, and under no circumstances are we responsible or liable for any third party’s compliance therewith.
